Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Aperture's website, console, APIs, marketplace, payments, and the Foundry runtime (the “Service”). By using the Service, you agree to these Terms.
1. Accounts and eligibility
You must be at least 18 and able to form a binding contract. You are responsible for your account, your API keys, and all activity under them — including the activity of autonomous agents you operate.
2. The Service
Aperture provides a single integration to third-party LLMs, APIs, and packaged skills, plus machine-to-machine settlement and hosted agent runtimes. Capabilities are provided by us or by third-party providers listed in the marketplace.
3. Acceptable use
- No unlawful, infringing, or harmful activity.
- No attempts to bypass metering, budgets, rate limits, or security controls.
- No use that violates a provider's terms or applicable export and sanctions laws.
- No generation of content prohibited by law or by the relevant provider's policies.
4. API keys and security
Keep your APERTURE_API_KEY confidential. You are responsible for requests made with your keys. Notify us promptly of any unauthorized use.
5. Payments, credits, and fees
The Service is usage-based. You pay each provider's per-call rate plus an Aperture routing fee, settled in fiat or crypto (including USDC via Circle). Free credits have no cash value. Except where required by law, fees for consumed usage are non-refundable. You are responsible for spend incurred by your agents up to the budgets and caps you configure.
6. Autonomous agents
You acknowledge that agents act on your behalf and may discover services, negotiate value, and settle payments automatically. You are solely responsible for configuring appropriate budgets, guardrails, and oversight. Aperture is not liable for outcomes produced by your agents.
7. Third-party providers
Capabilities you call are subject to the respective provider's terms and availability. Aperture is not responsible for third-party content, accuracy, or downtime.
8. Intellectual property
We retain all rights in the Service. You retain rights in your content. You grant us the limited rights needed to operate the Service and route your requests.
9. Disclaimers
The Service is provided “as is” without warranties of any kind, to the maximum extent permitted by law. Outputs from AI models may be inaccurate; you are responsible for evaluating them.
10. Limitation of liability
To the maximum extent permitted by law, Aperture will not be liable for indirect, incidental, or consequential damages, or for amounts exceeding the fees you paid in the three months before the claim.
11. Indemnification
You will indemnify Aperture against claims arising from your use of the Service, your content, your agents, or your violation of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or legal reasons. Certain provisions survive termination.
13. Governing law and changes
These Terms are governed by the laws of the jurisdiction stated in your order or, absent that, the State of Delaware, USA. We may update these Terms; continued use after changes constitutes acceptance.
